it was brought before congress in 2006, as "The Orphan Works Act of 2006" and later added to “The Copyright Modernization Act of 2006.” fortunately the 109th congress ended before this bill was ever addressed.
No bill addressing "orphaned works" has been brought to congress since then.

as a side note:
This bill was not all bad. Having worked in a photo lab years ago, we were not allowed to make a copy of ANY photograph, that even "looked" like it was taken by a "professional" photographer(ie 3 point lighting and a nice backdrop)even if there was no copyright notice printed on the photo. If you wanted to make a copy of your parents wedding photos from 1950, and were unable to locate the original photographer, then it is currently illegal for you to make a copy of said photo... the Orphaned Works bill addressed this as well as a few other issues. |
